Welcome to Apata! These Terms and Conditions ("Terms") govern your access to and use of the Apata platform ("App", "Website", or "Service"). By accessing, browsing, downloading, or using Apata, you agree to be bound by these Terms. If you do not agree, please do not use our platform.


1. Definitions

  • "Apata" refers to the digital platform owned by QuickGix Technologies, enabling real estate discovery, listing, and transaction facilitation.
  • "User" means any individual or entity accessing the platform to browse, search, or inquire about properties.
  • "Provider" refers to any agent, landlord, developer, or individual listing properties on Apata.
  • "Admin" refers to Apata's backend operator responsible for content moderation, compliance, and support.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • Providers must provide valid identification and agree to Apata's verification process.

3. Account Registration & Security

  • Users and Providers must provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify Apata immediately of any unauthorized use of your account.

4. Platform Usage

  • Users may search, filter, and communicate with Providers through the platform.
  • Providers may list properties, manage bookings, and engage with Users.
  • Apata reserves the right to limit, suspend, or terminate accounts for violations.

5. Listings and Content

  • Providers must ensure all listings are accurate, truthful, and updated.
  • Apata reserves the right to remove any listing deemed misleading, fraudulent, or inappropriate.
  • Providers must not upload copyrighted content unless they have the right to do so.

6. Fees and Payments

  • Basic usage of Apata is free; premium services such as listing, boosts, ads require  subscription tiers and credit purchases.
  • Fees are non-refundable unless otherwise stated.
  • Apata uses third-party payment providers (e.g., Paystack, Mobile Money) and is not liable for external processing errors.

7. Cancellations & Refunds

  • Users must deal directly with Providers regarding cancellations or rescheduling viewings.
  • Apata is not responsible for any refunds related to property rentals or purchases.

8. Dispute Resolution

  • Disputes between Users and Providers should first be resolved between parties.
  • If unresolved, Apata may intervene solely at its discretion and without obligation.
  • Apata is not a legal representative or arbitrator and assumes no liability for dispute outcomes.

9. Prohibited Activities

  • Submitting false information or impersonating others.
  • Circumventing platform fees by completing deals off-platform.
  • Uploading harmful code, phishing, or disrupting Apata systems.
  • Using Apata for unlawful or discriminatory purposes.

10. Intellectual Property

  • All platform content, branding, logos, and materials are the property of Apata and protected by applicable laws.
  • Users and Providers may not reuse, duplicate, or exploit any Apata materials without permission.

11. Limitation of Liability

  • Apata provides a marketplace and is not a party to any transaction between Users and Providers.
  • We do not guarantee the accuracy of listings or the conduct of Users or Providers.
  • To the fullest extent permitted by law, Apata is not liable for any indirect, incidental, or consequential damages.

12. Termination

  • You may terminate your account at any time.
  • Apata may suspend or delete accounts that violate these Terms or harm platform integrity.

13. Changes to Terms

  • Apata may update these Terms at any time. Users will be notified through email or in-app notifications.
  • Continued use of the platform constitutes acceptance of revised Terms.

14. Governing Law

  • These Terms are governed by the laws of the Republic of Ghana.
  • Any legal proceedings must be brought before the appropriate courts in Ghana.
